Terms of Service

These Terms are a binding contract between you and 1ownr LLC. Section 19 contains a binding arbitration agreement and a class action waiver that affect your legal rights. You may opt out of arbitration within 30 days of first accepting these Terms.
1. Agreement to These Terms
These Terms of Service ("Terms") are a binding contract between you and 1ownr LLC, a Connecticut limited liability company ("1ownr," "we," "us"), governing your use of the 1ownr website at www.1-ownr.com, the 1ownr application, and all related services (collectively, the "Service").
By creating an account, starting a free trial, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Section 19 contains a binding arbitration agreement and a class action waiver that affect your legal rights. Please read it carefully. You may opt out of arbitration within 30 days of first accepting these Terms.
2. Eligibility
You must be at least 18 years old and a resident of the United States to use the Service. The Service is offered only in the United States and is not intended for users located in the European Economic Area, the United Kingdom, or Switzerland. By using the Service you represent that you meet these requirements.
If you use the Service on behalf of a business or entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
3. What 1ownr Is — and What It Is Not
This section is fundamental to your use of the Service. Read it in full.
3.1 1ownr is a records organizer
1ownr is a private document storage and organization tool. It allows you to upload documents you already possess — receipts, service invoices, inspection reports and similar records — and arrange them into a chronological timeline. The Service also allows you to generate a shareable, time-limited view of that timeline (a "Vehicle Passport").
All content in the Service is submitted by the vehicle owner or account holder. 1ownr does not originate, collect, source, purchase, or independently obtain any vehicle record.
3.2 1ownr is NOT a vehicle history report
The Service is not a vehicle history report, and a Vehicle Passport is not a vehicle history report. 1ownr does not access, query, compile, or report data from:
- the National Motor Vehicle Title Information System (NMVTIS);
- state departments of motor vehicles or title records;
- insurance total-loss, salvage, or claims databases;
- auction records, lien records, theft records, or recall databases;
- law enforcement or accident records;
- any commercial vehicle history data provider.
1ownr is not an NMVTIS-approved data provider and does not provide NMVTIS vehicle history reports. A Vehicle Passport reflects only documents that an account holder chose to upload, and only to the extent that account holder chose to upload them. Records may be incomplete, out of order, altered, or entirely absent, and 1ownr has no way to detect this.
3.3 1ownr is NOT an odometer disclosure
A Vehicle Passport is not an odometer disclosure statement and does not satisfy any federal or state odometer disclosure requirement.
Federal law — the Truth in Mileage Act, 49 U.S.C. § 32705, and its implementing regulations at 49 C.F.R. Part 580 — requires the transferor of a motor vehicle to make a written odometer disclosure to the transferee in a prescribed form, generally on the certificate of title or a secure power of attorney. State law imposes parallel requirements.
Mileage figures that appear in a Vehicle Passport are transcriptions of numbers printed on documents you uploaded. They are historical data points from service records. They are not a statement by you or by 1ownr of the vehicle's actual mileage, they are not certified, and they do not fulfill your legal obligations as a seller. You remain solely responsible for making any legally required odometer disclosure through the proper channels.
3.4 1ownr is NOT a substitute for inspection or title verification
Neither the Service nor a Vehicle Passport is a substitute for, and neither should be relied upon in place of:
- a pre-purchase inspection by a qualified independent mechanic;
- a title search, lien search, or check for a branded, salvage, flood, or rebuilt title;
- an NMVTIS or commercial vehicle history report;
- a recall check via NHTSA or the manufacturer;
- a professional appraisal;
- any other independent diligence customary in a vehicle transaction.
3.5 1ownr makes no certification, verification, or warranty of any vehicle
1ownr does not inspect vehicles, does not authenticate documents, does not confirm that a document relates to the vehicle it is filed under, does not confirm that work described in a document was actually performed, and does not confirm that the person uploading a document is the vehicle's lawful owner.
Words such as "confirmed" or "reviewed" as used anywhere in the Service refer solely to the fact that the account holder reviewed and accepted an automated data extraction. They do not mean that 1ownr verified the underlying document, the work described, the mileage stated, or the vehicle's condition, ownership, or history.
1ownr is not a party to, agent for, broker in, or guarantor of any vehicle transaction.
4. Your Account
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly through our contact form of any unauthorized access. You must provide accurate registration information and keep it current.
5. Your Content
5.1 Ownership
You retain all ownership rights in the documents, images, notes, vehicle information and other material you upload or create in the Service ("Your Content").
5.2 License to us
You grant 1ownr a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, process, display and create derived data from Your Content solely for the purposes of (a) operating and providing the Service to you, (b) generating Vehicle Passports at your direction, (c) maintaining security and backups, and (d) complying with law. This license terminates when you delete the content or close your account, subject to the retention periods described in our Privacy Policy.
We do not use Your Content to train artificial intelligence or machine learning models, and we do not license Your Content to any third party for that purpose.
5.3 Your representations
You represent and warrant that you have the right to upload Your Content; that Your Content does not infringe any third party's rights; that you are the owner or authorized custodian of each vehicle you add; and that you will not upload documents you know or suspect to be forged, altered, or belonging to a different vehicle.
6. Automated Data Extraction
6.1 How it works
The Service uses automated software, including third-party artificial intelligence and optical character recognition services, to read uploaded documents and propose structured data such as dates, mileage figures, vendor names, costs and service descriptions ("Extracted Data").
6.2 Accuracy is not guaranteed
Extracted Data is generated by automated systems and will contain errors. These systems may misread handwriting, misinterpret poor-quality scans, transpose digits, confuse dates, misattribute line items, omit information, or generate values that do not appear in the source document at all. Errors in mileage figures and dates are the most consequential and are among the most common.
1ownr makes no representation or warranty that Extracted Data is accurate, complete, or corresponds to the source document.
6.3 Owner review is required and is your responsibility
Extracted Data is presented to you as a proposal for your review. You are required to compare each proposed value against the source document and correct it before accepting. By accepting Extracted Data, you represent that you have reviewed it against the source document and that you — not 1ownr — take responsibility for its accuracy.
Accepting Extracted Data without reviewing it is a violation of these Terms.
6.4 Source documents control
Where Extracted Data conflicts with the attached source document, the source document controls. Nothing in the Service alters or supersedes the content of any underlying document.
7. Vehicle Passports
7.1 You create and control them
A Vehicle Passport is a read-only, time-limited web view of records you select, generated at your direction and accessible to anyone holding the link. You determine what is included, what is redacted, and who receives the link.
7.2 You are responsible for what you share
You are solely responsible for the accuracy and completeness of any Vehicle Passport you create and for any statement, representation, or implication you make to any person in connection with sharing it. If you share a Vehicle Passport in connection with a vehicle sale, you remain fully subject to all obligations a seller owes a buyer under applicable law, including obligations regarding disclosure, misrepresentation, fraud, warranty, and odometer disclosure. 1ownr assumes none of those obligations and does not reduce, satisfy, or discharge any of them.
7.3 Anyone with the link can view it
A Passport link is a capability URL. Anyone who obtains it can view the Passport until it expires or you revoke it. Do not share a link with anyone you do not intend to have access. We cannot recall a link that has already been opened, copied, screenshotted, or forwarded.
7.4 No duty to update or preserve
A Vehicle Passport is a snapshot. We have no obligation to update it, to notify recipients of subsequent changes or deletions, or to preserve a Passport or its underlying records after expiration, revocation, or account closure.
7.5 No archival or evidentiary guarantee
The Service is not an archival, escrow, notarization, or evidentiary preservation system. Do not rely on the Service as your only copy of any document. Retain your own original records.
8. Terms for Passport Recipients
This Section 8 applies to any person who views a Vehicle Passport, whether or not they hold a 1ownr account. If you are viewing a Vehicle Passport, you agree to this Section 8.
- The contents were supplied entirely by the account holder who shared it with you. 1ownr did not source, verify, authenticate, inspect, or confirm any of it.
- This is not a vehicle history report. It contains no title, salvage, insurance, accident, theft, lien, auction, recall, or NMVTIS data. See Section 3.2.
- This is not an odometer disclosure. Mileage figures are transcriptions from documents and are not certified. See Section 3.3.
- Records may be incomplete, inaccurate, altered, or omitted, and there is no way to tell from the Passport that this has occurred. The absence of a record does not mean an event did not happen. The presence of a record does not mean the work was performed.
- Data shown may have been produced by automated extraction and may not match the source document. See Section 6.
- You must conduct your own independent diligence, including a pre-purchase inspection by a qualified mechanic, a title and lien check, and a commercial or NMVTIS vehicle history report, before purchasing any vehicle. See Section 3.4.
- You will not rely on a Vehicle Passport as a basis for any purchase decision. Any decision you make regarding a vehicle is made on your own judgment and independent diligence.
- 1ownr has no relationship with you regarding any vehicle transaction, owes you no duty of care with respect to the accuracy of any record, is not a party to your transaction, and makes no representation or warranty of any kind to you.
- Sections 16 (Disclaimer of Warranties), 17 (Limitation of Liability), 19 (Dispute Resolution and Arbitration) and 20 (Governing Law) apply to you in full with respect to any claim arising out of or relating to a Vehicle Passport or the Service.
9. Acceptable Use
You may not:
- upload forged, altered, fabricated, or misattributed documents, or documents relating to a vehicle you do not own or lawfully possess;
- use the Service to misrepresent a vehicle's condition, history, or mileage to any person;
- use the Service to commit or facilitate odometer fraud, title fraud, or any other unlawful act;
- upload another person's personal information without authorization;
- upload malware, or attempt to probe, scan, overload, reverse engineer, scrape, or gain unauthorized access to the Service;
- resell, sublicense, or provide the Service to third parties as a service bureau;
- use the Service to build a competing product or to extract data in bulk.
We may suspend or terminate any account for violation of this Section, and may report suspected fraud to law enforcement.
10. Subscriptions, Free Trial, Automatic Renewal, and Cancellation
10.1 Plans
1ownr Free supports 1 vehicle at no cost. 1ownr Garage is $5.00 per month and supports up to 3 vehicles. 1ownr Fleet is $15.00 per month and supports up to 5 vehicles. Prices are in U.S. dollars and exclude applicable taxes, which may be added at checkout.
10.2 Free trial
New subscribers receive a 7-day free trial. You must provide a payment method to start the trial. Unless you cancel before the trial ends, your paid subscription begins automatically at the end of the trial and your payment method is charged the applicable monthly fee.
10.3 Automatic renewal — please read
Your subscription automatically renews every month until you cancel.
At the end of each monthly term, we will automatically charge your payment method the then-current fee for the next month, without further notice or action by you, until you cancel. You authorize us and our payment processor to store your payment method and charge it on this recurring basis.
10.4 How to cancel
You may cancel at any time, effective at the end of your current billing period, from your account settings under Billing, in two clicks, with no requirement to call, chat, or email us. Cancellation during a free trial takes effect immediately and no charge is made. Cancellation of a paid subscription takes effect at the end of the paid period; you retain access until then.
10.5 Refunds
Monthly fees are non-refundable except where required by law. We do not provide refunds or credits for partial months, unused vehicles, or periods of non-use. We may, at our sole discretion, issue a refund in individual cases; doing so creates no obligation to do so again. See our Refund and Billing Policy.
10.6 Price changes
We may change prices. We will give you at least 30 days' advance notice by email before a price change takes effect for your subscription. The new price applies at your next renewal after the notice period. If you do not agree, cancel before the change takes effect.
10.7 Failed payments
If a charge fails, we may retry, suspend your access, and after 30 days downgrade or close your account. You remain responsible for amounts owed.
10.8 Taxes
Fees exclude sales, use, and similar taxes. Where we are required to collect tax on digital services, it will be added to your charge and shown at checkout.
11. Third-Party Services
The Service depends on third-party providers for hosting, storage, payment processing, email, and automated data extraction. Payment card details are collected and processed by our payment processor; we do not receive or store full card numbers. We are not responsible for the acts, omissions, availability, or terms of third-party providers. A current list of our processing vendors is maintained in our Privacy Policy.
12. Intellectual Property
The Service, including its software, design, trademarks, logos, and the "1ownr" and "Vehicle Passport" names, is owned by us and protected by intellectual property law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes in accordance with these Terms. No other rights are granted.
13. Feedback
If you send us suggestions or feedback, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use it for any purpose without obligation or compensation to you.
14. Copyright Complaints
If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent through our contact form.
Your notice must include the elements required by 17 U.S.C. § 512(c)(3). We will respond to valid notices and may terminate repeat infringers.
15. Term, Termination, and Data Export
You may close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we suspect fraud or unlawful use, if required by law, or if we discontinue the Service.
Before you close your account, export your records. Upon account closure, active Passport links are revoked and your content is deleted in accordance with the retention schedule in our Privacy Policy. If we discontinue the Service, we will give you at least 30 days' notice and an opportunity to export your data.
Sections 3, 5.3, 7.2, 8, 12, 13, 16, 17, 18, 19 and 20 survive termination.
16. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranty of any kind. To the fullest extent permitted by law, 1ownr disclaims all warranties, express, implied, statutory or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
Without limiting the foregoing, 1ownr specifically disclaims any warranty that: Extracted Data is accurate or corresponds to its source document; that records in the Service are complete, authentic, or relate to the vehicle under which they are filed; that a Vehicle Passport presents a complete or accurate picture of any vehicle's history, condition, mileage, or ownership; that the Service will be uninterrupted, secure, or error-free; or that data will not be lost.
No advice or information obtained from 1ownr creates any warranty not expressly stated here. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the fullest extent permitted.
17. Limitation of Liability
To the fullest extent permitted by law, 1ownr and its officers, members, employees, contractors and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, vehicle value, or business opportunity, arising out of or relating to the Service, whether based in contract, tort, negligence, strict liability, misrepresentation, statute or any other theory, and whether or not we were advised of the possibility of such damages.
Without limiting the foregoing, 1ownr will not be liable for any loss arising from: (a) inaccurate, incomplete, missing, altered, or misattributed records; (b) errors in Extracted Data; (c) any decision to buy, sell, price, insure, repair, or not purchase any vehicle; (d) any dispute between a buyer and a seller; (e) any failure to satisfy an odometer, title, or other legal disclosure obligation; or (f) disclosure of a Vehicle Passport by a recipient.
In no event will the total aggregate liability of 1ownr for all claims arising out of or relating to the Service or these Terms exceed the greater of (i) the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars ($100). For any person who has not paid us any amount, including any Passport recipient, the cap is one hundred U.S. dollars ($100).
These limitations apply even if a limited remedy fails of its essential purpose, and they form an essential basis of the bargain between us; we would not provide the Service at these prices without them.
Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, or any liability that cannot be limited under applicable law. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; in those jurisdictions our liability is limited to the fullest extent permitted.
18. Indemnification
You will defend, indemnify and hold harmless 1ownr and its officers, members, employees and contractors from any claim, demand, loss, liability, damage, cost or expense (including reasonable attorneys' fees) arising out of or relating to: (a) Your Content; (b) any Vehicle Passport you create or share; (c) any statement or representation you make to any person about a vehicle; (d) any vehicle transaction you enter into; (e) your breach of these Terms or violation of law; or (f) your infringement of any third party's rights.
We may assume exclusive defense and control of any matter subject to indemnification, at your expense, and you will cooperate with us.
19. Dispute Resolution; Binding Arbitration; Class Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
19.1 Informal resolution first
Before filing any claim, you agree to send a written notice describing the dispute and the relief sought through our contact form and to negotiate in good faith for 60 days. This is a condition precedent to arbitration. The limitations period is tolled during this period.
19.2 Agreement to arbitrate
If the dispute is not resolved, you and 1ownr agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this Section. The arbitrator has exclusive authority to resolve any dispute about the scope, enforceability, or formation of this arbitration agreement, except that a court decides the enforceability of Section 19.4.
Arbitration will be conducted in Fairfield County, Connecticut or, at your election, in your county of residence, by telephone, by videoconference, or on written submissions.
19.3 Exceptions
Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property or to stop unauthorized access to the Service.
19.4 Class action and jury trial waiver
You and 1ownr each waive the right to a jury trial and the right to participate in a class, collective, consolidated, or representative action.
The arbitrator may award relief only to the individual party seeking it. If this Section 19.4 is found unenforceable as to any claim, that claim must proceed in court and is severed from arbitration.
19.5 Coordinated filings
If 25 or more similar demands for arbitration are filed by or with the assistance of the same counsel, the parties will follow the AAA's applicable mass or multiple-case filing procedures, and the demands will be batched for administrative and fee purposes.
19.6 30-day opt out
You may opt out of this arbitration agreement by using our contact form to send your name, account email, and a statement that you opt out of arbitration, within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms and will not affect your account.
19.7 Time limit
Any claim must be brought within one (1) year after it arises, or it is permanently barred, except where a longer period is required by law.
20. Governing Law and Venue
These Terms are governed by the laws of the State of Connecticut, without regard to conflict of laws principles. For any matter not subject to arbitration, the state and federal courts located in Fairfield County, Connecticut have exclusive jurisdiction, and you consent to their jurisdiction and venue.
21. Changes to These Terms
We may modify these Terms. For material changes, we will give notice by email or in-app at least 14 days before they take effect and update the "Last updated" date. Continued use after the effective date constitutes acceptance. If you do not agree, cancel your subscription and stop using the Service. Changes do not apply retroactively to disputes already noticed under Section 19.1.
22. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between us regarding the Service and supersede all prior understandings.
- Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder stays in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets, subject to the notice obligations in our Privacy Policy.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
- Notices. We may give notice by email to your account address or by posting in the Service. Notices to us go through our contact form.
- Relationship. No agency, partnership, employment, joint venture or fiduciary relationship is created by these Terms.
- No third-party beneficiaries, except that Section 8 binds Passport recipients and our officers, members, employees and contractors are beneficiaries of Sections 16, 17 and 18.
